Apply for a Sponsorship Licence, Sole Rep Visa, an Innovator Visa or Investor Visa
There are a range of visas available to businesses in the UK and overseas. A UK business visa can be a Sole Representative of an Overseas Business, a Tier 1 Entrepreneur extension, Innovator Visa or a Start Up Visa.
Businesses can only sponsor a foreign worker that they would like to employ if the company holds a Sponsorship Licence and are a Sponsor listed on the Register of Sponsors.
The Home Office updates the Sponsorship Register of Sponsors every day on its website. All the Skilled Worker visa, Tier temporary visa, Health & Care visas are sponsored by the registered Sponsor employer.
The Home Office has introduced new visa categories for people who wish to start a business in the UK by replacing some categories with the old Tier 1 Entrepreneur visa category.
Start Up visa & Innovator visa both fall under Appendix W of the Immigration rules and allows the applicants to run their own business in the UK. Applicants can bring their family to the UK and their children can attend British schools.
Requirements for UK Business Visas
All the UK Visas have their own set of requirements to be met. Applicants can either apply for the relevant visa themselves or instruct an OISC regulated Immigration Lawyer to advise them and represent them to the UKVI & Home Office.
Different requirements are to be met for different visa categories and different timelines for processing of these visas are observed. Applications from some countries are processed faster than the others.
All the visas can be applied from outside the UK but not all of them can be applied from within the UK, therefore it is very important you either consult the Guidance of the visa you wish to apply for or an Immigration Lawyer / Solicitor who can advise you.
Sole Rep Visa
The Sole Representative Visa is a highly specialised visa explicitly designed to allow companies from abroad access to the UK to set up and manage the commercial branch of their business. The sole representative is a single senior individual that oversees and handles the foundations of a UK office, branch or expansion of a company run from anywhere else in the world.
Innovator Visa is designed for entrepreneurs who want to set up a business in the UK and run it. The Innovator visa is designed for experienced businessmen or businesswomen who already have good financial backing.
For an Innovator Visa the applicant needs to have a good business plan and they also need to have endorsement (ie approval) for the business plan from an endorsing body approved by the Home Office, which could be either a private body or in some cases a university.
The applicant will need to have a minimum of £50,000 available to invest in their business. If more than one applicant is doing a joint business venture then each applicant needs to have at least £50,000 of funds available to invest in their business. So, if there are two applicants but 1 business idea they both need to show £50k each and in total funds of £100,000.The Innovator visa is granted for three years and the applicant can apply for settlement or for a visa extension at the end of 3 year period.
For the initial application the Tier 1 Investor visa applicant needs to show that they have at least £2 million to invest which is under your control. You also need to show that you hold a UK bank account.
After you have acquired the initial visa the Tier 1 Investor visa applicant must subsequently show that they have invested the funds into a UK-registered company (ies) either by way of loan capital or share capital.
If you invest £2 million you can potentially acquire settlement in five years; if you invest £5 million you can potentially acquire it in three years; and if you invest £10 million you can potentially acquire it in two years.
The visa is initially granted for three years or three years and a bit, so an extension visa application may or may not be necessary, depending on the length of the route.
