Apply for leave outside the immigration rules and human rights applications. Sometimes a migrant may be in the UK without leave but does not qualify to apply for leave under the Private Life-Long Residence rules or the Family Partner rules.
However, they may nonetheless be able to apply for leave outside the immigration rules, and typically on the basis of Article 8 of the European Convention on Human Rights. This Article is something quite separate from the immigration rules and protects the right to private and family life.
If you have lived in the UK for a considerable period and/or have a genuine relationship with a qualifying partner, child or possibly another kind of family member you are able to apply for limited leave on this basis.
Requirements for an application made outside the rules
You must be able to prove, as far as possible, that you have been in the UK for the period you claim. You must also provide evidence about your private life (job, social network etc) and any family life. If you have family and friends in the UK they can support your application to remain in the UK.
