Routes to Business Immigration Under the Immigration Rules

There is a range of UK visas available to businesses and entrepreneurs, including:

  • Innovator Founder visa
  • UK Expansion Worker visa
  • Scale-up Worker visa
  • Skilled Worker visa
  • Senior or Specialist Worker visa

The Innovator Founder visa enables an aspiring entrepreneur, who may be outside the UK but possibly already in the UK, to set up a business in the UK and run it.

The visa is granted for three years and an extension may be possible. Settlement may also be possible after three years for the main applicant and family members if all the relevant requirements are met.

The UK Expansion Worker visa is designed for overseas companies which have no commercial presence in the UK to set up either a branch or a wholly-owned subsidiary in the UK. A suitably-experienced employee sponsored by the overseas company may apply for the visa so they can come to the UK to set up the entity and run it, and they are able to bring eligible family members with them.

The visa is granted for one year and may be extendable for a further year but there is no route to settlement. If the migrant wants to achieve settled status they would have to switch to another kind of visa, such as a Skilled Worker visa, which provides such a route.

The Scale-up Worker visa is a rather specialist route, geared specifically to UK companies which have a proven record of fast expansion and want to continue to grow. The company may sponsor a Scale-up Worker to join the company in a suitably skilled job and assist with further expansion.

This is a very flexible visa. It is granted for two years and can potentially be extended. The migrant only has to work for the sponsoring company for six months; after that they are allowed to start work for a new employer.

Settlement may be possible after five years for the main applicant and any family members.

The Skilled Worker visa is a visa route that enables UK-based firms and organisations to employ skilled and well-qualified workers in deemed skilled jobs. Some firms find that they cannot get the skilled workers they need from the indigenous workforce and that they need to recruit from outside the UK. In some cases a migrant already in the UK can switch visas to a Skilled Worker visa. In order to sponsor Skilled Workers the firm needs to hold a Skilled Worker Sponsor Licence.

The Senior or Specialist Worker visa is similar to the Skilled Worker visa, and is for international companies which have a commercial presence both in the UK and abroad and which wish to transfer a senior skilled employee from an overseas entity to work for the UK entity. In order to do this the UK entity must hold a Senior or Specialist Worker Sponsor Licence.

Requirements for UK Business Visas

All these visas have their own set of requirements to be met. Applicants can either apply for the visa themselves or instruct an OISC regulated Immigration Lawyer to advise them and represent them before the UKVI & Home Office.

Different requirements have to be met for different visa categories and applications from some countries are processed faster than the others.
